The Interview with INS
The interview with INS at the local office can range from very short to very long depending on how much effort that the officer charged with handling the adjustment wants to put into it. The interviewing officer will look at the factors in the case and determine what level of scrutiny your case will receive. The purpose of the interview is to determine eligibility of the alien for the resident alien benefit. The officer is looking for a sham marriage. Whatever level of scrutiny he puts, if your heart is pure, you have nothing to worry about.
When you go
to the interview, you are expected to be in possession of a list of items
that you are informed about in your interview notice. In addition, you
must bring the originals for all documents that you have previously submitted.
The list of items include driver's licenses, various forms of insurance,
grant deeds on property, automobile loans and leases, tax returns, pay
stubs and other such items. At this time, your spouse will have had another
medical examination from an INS approved civil surgeon. A list of these
doctors are sent with the notice letter. I would also advise that you
bring wedding pictures, vacation pictures, and pictures of the two of
you with family members. Married couples have pictures taken together-
INS does not buy the story that your marriage is somehow different from
all the hundreds of other cases that they see. In the same vein, married
couples join their lives, personal and financial, together. Evidence of
separate holdings can be negatives in the eyes of the interviewing officer.
Also bring with you other records showing an ongoing relationship, such
as telephone bills and mail, bank accounts, credit card statements, letters
from employers showing beneficiary status, and identity documents showing
any name changes.
Here are examples of four marriage interviews that I have seen at the Los Angeles INS offices. There may be some variations of these interviews but most of these interviews will follow this format.
